Is Trump’s Behavior Treasonous?

At this point, 17 US national intelligence agencies have unanimously concluded that the Russians have hacked the American presidential elections. The CIA also claims that the Russians’ motive was to elect Donald Trump. Both Republican and Democratic congressional leaders are calling for a full investigation over this national scandal. President Obama is vowing retaliation against the Russians at the place and time of America’s choosing. Only Donald Trump seems isolated in defending Putin and the Russian regime for their behavior. Harvard University professor John Shattuck, in a scathing article in the Boston Globe, wonders whether Trump’s behavior amounts to treason. He writes, “[T]he federal crime of treason is committed by a person ‘owing allegiance to the United States who . . . adheres to their enemies, giving them aid or comfort,’ and misprision of treason is committed by a person ‘having knowledge of the commission of any treason [who] conceals and does not disclose’ the crime. By denigrating or seeking to prevent an investigation of the Russian cyberattack Trump is giving aid or comfort to an enemy of the United States, a crime that is enhanced if the fourth explanation applies — that he is in fact seeking to cover up his staff’s or his own involvement in or prior knowledge of the attack.” This is a very serious allegation against Trump.
